Welcome to EstiMate. By accessing or using this service, you agree to the following Terms of Service. Please read them carefully before uploading an estimate or completing a purchase. If you do not agree to these Terms, do not use the service.

1 Description of Service

EstiMate provides informational and educational estimate analysis designed to help users better understand insurance repair estimates and identify areas that may warrant further review or clarification.

EstiMate does not provide licensed professional advice or services.

2 No Professional Advice

The content provided by EstiMate is for informational and educational purposes only. EstiMate does not provide:

  • Legal advice
  • Public adjusting services
  • Construction or repair advice
  • Insurance coverage determinations
  • Engineering or professional consulting services

You should consult with an appropriately licensed professional — such as a contractor, public adjuster, lawyer, engineer, or insurance professional — before making decisions related to your estimate, claim, repairs, or coverage.

3 No Reliance

You acknowledge and agree that:

  • Reports generated by EstiMate are not definitive or exhaustive.
  • Findings are prompts for further review, not factual conclusions.
  • Estimates and claims vary significantly depending on project conditions, insurer requirements, jurisdiction, pricing, workmanship standards, hidden conditions, and site-specific circumstances.
  • You are solely responsible for any decisions or actions taken based on the report.

You agree not to rely solely on EstiMate for financial, legal, insurance, construction, or repair-related decisions.

4 Limitation of Liability

To the maximum extent permitted by applicable law, EstiMate and its owners, operators, affiliates, licensors, contractors, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the use of the service or any report generated by the service.

This includes, without limitation:

  • Financial losses
  • Claim outcomes
  • Repair costs
  • Delays
  • Missed scope
  • Additional scope
  • Errors or omissions
  • Disputes with insurers, contractors, consultants, or third parties

Your use of EstiMate is entirely at your own risk.

To the maximum extent permitted by law, EstiMate’s total aggregate liability arising from or related to the use of the service shall not exceed the amount paid by you for the specific report giving rise to the claim.

5 No Warranties

EstiMate is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, EstiMate disclaims all warranties, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability
  • Accuracy
  • Compatibility
  • Security
  • Uninterrupted or error-free operation

We do not warrant that the service will be free from interruptions, delays, inaccuracies, omissions, defects, or technical errors.

6 Accuracy Disclaimer

While EstiMate is designed to provide structured and consistent analysis, we do not guarantee:

  • Accuracy
  • Completeness
  • Reliability
  • Suitability
  • Applicability to your specific circumstances

Insurance estimates, pricing, construction methods, and claim handling practices vary widely, and reports may not reflect all relevant project conditions, hidden damage, policy limitations, jurisdiction-specific requirements, workmanship standards, or insurer-specific guidelines.

7 Third-Party Information Disclaimer

EstiMate relies on information and documents provided by users and third parties, including insurance estimates, contractor scopes, pricing data, and related materials.

EstiMate is not responsible for inaccuracies, omissions, formatting issues, incomplete information, or errors contained in third-party documents or source materials uploaded to the service.

8 User Responsibilities

You agree that:

  • You will provide accurate and lawful information.
  • You will not upload content you do not have the legal right to use.
  • You understand the service is a review tool and not a substitute for professional judgment or inspection.
  • You are responsible for independently verifying any information before acting on it.
  • You will not use the service for unlawful, fraudulent, abusive, or misleading purposes.

9 Prohibited Uses

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to extract source logic, rule structures, methodologies, or proprietary workflows from the service
  • Use automated tools, bots, scripts, or scraping systems to access or extract data from the platform
  • Reproduce, resell, redistribute, sublicense, or commercially exploit reports or platform outputs without authorization
  • Attempt to interfere with the operation, security, or integrity of the service
  • Use the platform in violation of applicable laws or regulations

10 Intellectual Property

All content, software, report structures, logic systems, workflows, branding, designs, methodologies, text, graphics, and underlying platform functionality are the property of EstiMate or its licensors and are protected by applicable intellectual property laws.

Use of the service does not grant you ownership of the platform or any underlying systems, logic, or intellectual property.

11 Data Usage

By using the service, you acknowledge and agree that uploaded documents and derived data may be processed and stored for purposes including:

  • Generating reports
  • Improving system performance
  • Enhancing rule accuracy and estimate interpretation
  • Product development and quality assurance
  • Internal testing, debugging, and analytics

Where reasonably possible, data used for improvement purposes may be anonymized or de-identified.

You may request deletion of your uploaded data where applicable by contacting us using the information provided in Section 17.

12 Payments and Access

Access to reports requires payment. By completing a purchase, you agree to:

  • Pay all applicable fees at the time of submission
  • Provide accurate billing information
  • Understand that digital services may become non-refundable once report generation has begun or the report has been delivered

Payments are processed securely through Stripe. EstiMate does not store payment card information.

We may modify, suspend, discontinue, or restrict access to the service at any time without notice or liability.

13 Refund Policy

Because EstiMate provides digital services and generates custom reports immediately after submission, purchases are generally non-refundable once report generation has begun or a report has been delivered.

However, we may, at our sole discretion, provide refunds in limited circumstances, including:

  • Duplicate charges
  • Technical failures preventing report delivery
  • Corrupted or unreadable reports caused by system error
  • Other exceptional circumstances determined by EstiMate

Refund requests must be submitted within a reasonable time after purchase by contacting team@myestimateapp.com.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

14 Dispute Resolution

Any dispute arising out of or relating to these Terms or the use of EstiMate shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved informally, it shall be resolved through binding arbitration, except where prohibited by applicable law.

Arbitration shall take place in British Columbia, Canada, and the parties waive any right to participate in a jury trial or class-action proceeding to the extent permitted by law.

15 Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of British Columbia, Canada, without regard to conflict-of-law principles.

16 Changes to These Terms

We may update these Terms from time to time. When updates are made, the “Last Updated” date at the top of this page will be revised.

Continued use of the service after changes are posted constitutes acceptance of the updated Terms.

We recommend reviewing these Terms periodically, particularly before submitting a new estimate.
